Apple Accuses OpenAI of Illegally Acquiring AI Hardware Trade Secrets

In a significant legal move, Apple has initiated a lawsuit against OpenAI in a federal court in the United States, accusing the company of illicitly obtaining and using its confidential trade secrets. The lawsuit centers on allegations that OpenAI misappropriated sensitive information related to Apple’s hardware development, manufacturing techniques, and intricate supply chain operations.

The complaint filed by Apple outlines accusations that former employees who transitioned to OpenAI retained proprietary data, which allegedly conferred an unfair advantage to the AI company as it ventures into developing its speculated consumer AI hardware. Apple claims the misconduct involved not only the sharing of confidential information by these ex-employees but also attempts by OpenAI to solicit Apple’s suppliers and gather sensitive insights during recruitment processes.

A key focus of the lawsuit is on several former Apple personnel, including Chang Liu, who reportedly did not return a company-issued laptop upon departure. Another prominent figure mentioned is Tang Yew Tan, who served as a senior executive at Apple before becoming OpenAI’s Chief Hardware Officer. He is accused of engaging in discussions with OpenAI associates and Apple suppliers prior to his exit from Apple.

Apple’s lawsuit further asserts that OpenAI and its associated entities have been systematically targeting Apple’s proprietary technology, manufacturing acumen, product development strategies, and supplier networks. This, Apple contends, is part of OpenAI’s strategy to expedite its entry into the competitive consumer AI hardware sector.

According to Apple, more than 400 of its former employees have since joined OpenAI. The tech giant claims it previously communicated its concerns directly to OpenAI but received no acknowledgment or response. In the lawsuit, Apple is seeking court injunctions to halt the alleged use of its trade secrets and is also pursuing financial compensation for what it describes as intentional and malevolent infringement of its confidential business information. OpenAI, as of now, has not issued any public statement regarding these allegations.
